New Market Joint Ventures

Partnering in the most appropriate way

• Negotiating a complex joint operations arrangement between an oil and gas supermajor and a major state-owned upstream oil and gas operator

• Negotiating and drafting teaming agreements, and other forms of pre-bid contractual form, for a broad range of types of collaborative project

Their key strength has been in the context of acquisition and divestment in developing markets, such as Indonesia, Vietnam, Oman and Qatar, for example:

• Acting for a MNC in connection with the purchase of a non-operator participant share in the development of a liquefied natural gas facility

• Acting for an international operator in connection with the acquisition and divestment of various assets in Vietnam and Indonesia

• Advising operators in connection with the development and project financing of power generation projects

​

• Acting for owner/employers in connection with a number of complex greenfield engineering construction, and building projects

Construction

New Projects and Claims Resolution

Inarak's consultants have a wealth of professional experience in the international building construction and engineering construction sectors, for example:

​

• Designing and drafting a new suite of standard form engineering construction contracts for a major upstream oil and gas company in Oman

​

• Representing the Employer in a multi-million dollar contractual claim brought by the client's main EPC contractor

​

• Negotiating amendments to the FIDIC-based project contracts for a large-scale commercial building in Jakarta, Indonesia 

​​

• Acting for the project company/concession holder in connection with the development of a seaport facility

​

• Reviewing, commenting on, and revising the standard form construction contracts used by the Ministry of Transport in a Middle Eastern state

​

• Representing the EPC contractor in the negotiation of the terms and conditions of the EPC contract

Disputes Resolution

Finding the best outcome when there are disagreements

Inarak's consultants have represented clients in commercial and contractual disputes leading in many cases to litigation and arbitration, and has focused on disputes in the energy industries, in international trade, and in the construction sector, for example:

• Acting for a state-owned operator in connection with a number of engineering construction disputes with the operator’s EPC contractors

• Acting for a range of clients in connection with labour disputes in their overseas operations

​
